TAXES & FEES
When selling Property in Tenerife, there are a number of taxes which you will need to consider. When you sell a property in Tenerife you will be subject to the following taxes.
Plus Valia Tax:
Plus Valia is a tax based upon the increase in land value of a property between the last sale and the current sale.
The land values are recorded in the local town-hall and are updated every 2-3 years.
Plus Valia Tax is by Spanish Law paid by the seller, unless negotiated that the Buyer pays and is usually less than 1500 Euros but may be considerably more if the property has been owned for more than ten years.
Non Residents 3% Tax Retention:
If you are a non-resident when selling a property in Tenerife there us a 3% retention of the total purchase price of the property which is imposed by the Spanish tax Authorities against and capital gains tax and any other outstanding taxes. Once the Spanish tax authorities have been paid any of your outstanding tax debts out of the 3% retention, the remaining monies, less your tax bill will be refunded to you. If you are a resident there will be no 3% retention but the sale will have to appear on your annual tax declaration. Your personal fiscal representative will be able to tell you exactly what your personal current tax situation is.
Capital Gains Tax
Capital Gains Tax is payable by the vendor whenever they make a profit from the sale of a property, except in the following circumstances. When the proceeds of the sale are used for the purchase of a new home, they must be reinvented in another property within two years of the sale.
To qualify for this exemption, the property you are selling must be your permanent home, meaning that you have to be a resident in Tenerife for tax purposes. If you have been a fiscal resident in Spain and are over 65 years of age and selling your primary residential property you will have no capital gains tax to pay.
